Welcome to Fifty Fifty. These Terms and Conditions ("Terms") govern your use of our website (fiftyfifty.design) and the purchase of any branding, design, or Webflow development packages from Fifty Fifty Design Ltd. By accessing our site or engaging our services, you agree to be bound by these Terms.

1. Our Business Model

Fifty Fifty Design Ltd operates as a distributed creative studio utilizing a collective framework of independent freelance design and development specialists. We coordinate, manage, and stand behind all work shipped under our brand, ensuring it hits our rigorous engineering standards.

2. Intellectual Property Rights

Unless otherwise explicitly agreed in a separate signed Client Agreement:

  • Our IP: We retain all intellectual property rights in our pre-existing design frameworks, baseline Webflow development structures (including custom Lumos code systems), and core workflows.
  • Your IP: Upon receipt of full and final payment for your designated project package, all bespoke brand identities, custom visual designs, and final Webflow CMS content assets built specifically for your business will transfer fully to your ownership.
3. Client Responsibilities & Autonomy

We build Webflow websites that empower your internal team with content management autonomy. Following site delivery and our designated onboarding training, you assume full responsibility for any content changes, template alterations, or third-party integration maintenance executed by your internal team.

4. Limitation of Liability

To the maximum extent permitted by law, Fifty Fifty Design Ltd shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, data, or website downtime, resulting from the deployment, migration, or use of our custom digital products. Our total liability under any engagement shall not exceed the total fees paid by you to us for that specific project scope.

5. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of Scotland. You agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute.
